This AUP governs the use of all hosting services, hosting solutions, cloud services, and other offerings (the “Services”) made available by Searchen Networks and its suppliers and affiliates (“Internet Marketing Services Inc.”). This AUP is an integral part of your agreement with Searchen Networks and is incorporated by reference into the terms under which Searchen Networks provides you with the right to access or use the Services. By accessing or using the Services, you agree to the terms of this AUP. Searchen Networks reserves the right to modify this AUP at any time, with such changes becoming effective immediately upon posting the revised AUP or notifying you of the changes.
General Statement
The purpose of this AUP is to provide guidelines for users of the Services and to outline behaviors and content that conflict with Searchen Networks’ mission and values. This AUP aims to protect the Services, employees, customers, and end users from inappropriate, abusive, or illegal activities. Searchen Networks may suspend or terminate your right to access and use the Services if it determines that you have violated this AUP.
Responsibilities and Prohibited Use
You are responsible for the actions of your agents, representatives, and end-users (“Users”) and must ensure that they adhere to this AUP. The Services are to be used strictly for legitimate business and commercial purposes. You must not use the Services in any manner that, in Searchen Networks’ sole discretion, is illegal, offensive, or disruptive, or in a way that interferes with or negatively impacts the Services (including deliberate attempts to overload systems or broadcast attacks) or exposes Searchen Networks to civil or criminal liability. The following is a non-exhaustive list of prohibited activities. You and your Users agree not to use the Services for:
- Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, or interfering with any other user’s use of the Services.
- Unauthorized access, monitoring, collection, or use of data, systems, or networks.
- Transmitting, distributing, or storing illegal or fraudulent information, or material that infringes on intellectual property, privacy, or personal rights, including copyrights, patents, trademarks, trade secrets, or other proprietary rights.
- Engaging in offensive activities such as harassment or distributing inappropriate, obscene, defamatory, threatening, abusive content, or advocating violence, or that violates any law, regulation, or public policy.
Additionally, you and your Users must comply with all applicable laws, including data protection and privacy regulations, and laws related to unsolicited commercial electronic messages.
Searchen Networks’ Rights
Searchen Networks reserves the right to investigate any actual, suspected, or alleged violations of this AUP. You agree to cooperate reasonably with Searchen Networks in investigating and addressing any violations by yourself or your Users. Searchen Networks further reserves the right to collaborate with legal authorities and third parties in investigating any alleged violations, including disclosing the identity of any User believed to be responsible. Searchen Networks may also implement technical measures to prevent violations of the AUP.
This AUP does not limit Searchen Networks’ legal rights or remedies.
Consequences of Violations
If Searchen Networks reasonably believes that you or your Users have violated this AUP, it may suspend your Services without prior notice, terminate your agreement with Searchen Networks, and/or block any traffic that it reasonably believes violates this AUP. In addition to other remedies, Searchen Networks may charge you its standard hourly rate along with reasonable legal fees and the cost of any equipment or materials needed to investigate and address any violations.
Disclaimer
Searchen Networks is not obligated to monitor user activities and disclaims responsibility for any misuse of the Services by Users. Searchen Networks is not responsible for any third-party materials or information created, stored, transmitted, or accessible through the Services and is not required to exercise editorial control over such materials. However, if Searchen Networks becomes aware of any material that violates this AUP and/or exposes it to civil or criminal liability, Searchen Networks may block access to such material. Unless specifically outlined in this AUP, Searchen Networks disclaims any obligation to individuals who have not entered into an agreement for the use of the Services.
Reporting Violations
If you become aware of any violations of this AUP by anyone, including your Users, you must immediately notify Searchen Networks by sending a Abuse Report here.
